CPCF v Minister for Immigration and Border Protection & Anor [2014] HCATrans 227 [2014] HCATrans 227

CaseChat Overview and Summary

The applicants, CPCF and others, sought judicial review of decisions made by the Minister for Immigration and Border Protection concerning their immigration status. The core of the dispute involved the lawfulness of the Minister's decision to refuse to revoke a decision to cancel their visas, and the subsequent detention of the applicants. The matter was heard by the High Court of Australia.

The High Court was required to determine whether the Minister's refusal to revoke the visa cancellation decisions was vitiated by an error of law. Specifically, the Court considered whether the Minister, in exercising the power under s 501(3B) of the Migration Act 1958 (Cth) to refuse to revoke a cancellation decision, was bound by the same considerations that applied to the initial decision to cancel the visa under s 501(3A). The Court also had to consider the lawfulness of the applicants' detention pending the outcome of these proceedings.

The Court reasoned that the power to refuse to revoke a visa cancellation under s 501(3B) was a distinct power from the power to cancel a visa under s 501(3A). It held that the Minister was not bound to consider the same factors when refusing to revoke a cancellation as were relevant to the initial cancellation. The Court emphasised that the statutory language of s 501(3B) did not impose such a requirement. Furthermore, the Court found that the detention of the applicants was lawful, as it was a consequence of their status as non-citizens whose visas had been cancelled and who had not been granted a substantive visa.

The High Court dismissed the applications for judicial review.
