In a property settlement matter before Justice Benjamin, the Court was asked to determine the division of an asset pool valued at approximately $2.2 million between the husband and wife. Justice Benjamin found that the contributions of both parties were equal. The Court made a 10% adjustment in favour of the wife, taking into account various factors under section 75(2) of the Family Law Act 1975 (Cth), including the disparity in their income-earning capacities, the shared care of older children, and the wife's health issues. The Court ordered the transfer of certain properties and chattels to the wife, along with a significant cash payment. The Family Trust was directed to transfer an abalone unit to the wife, and the Warehouse was to be sold by public auction, with the net proceeds to be distributed 60% to the wife and 40% to the husband. The wife's application for spousal maintenance was dismissed, as she was found to have the capacity to generate income of $270 per week from the assets allocated to her. The Court also made detailed orders regarding the discharge of mortgages, indemnities for various liabilities, and the division of tax obligations related to the Family Trust and the sale of assets.
