CaseChat Overview and Summary
The court was required to determine whether the Enterprise Agreement met the criteria for approval under section 233 of the Fair Work Act. The key legal issue was whether the agreement contained terms that were contrary to the public interest, as outlined in section 234 of the Act. The court also needed to consider whether the agreement had been made in accordance with the procedural requirements of the Fair Work Act.
The court found that the agreement did not contain any terms that were contrary to the public interest. It was also satisfied that the agreement had been made in accordance with the procedural requirements of the Fair Work Act. The court noted that the agreement had been negotiated in good faith and that the employees had been given an opportunity to vote on the agreement. The court held that the agreement met the criteria for approval and granted the application for approval.
The court ordered that the Enterprise Agreement between Costa's Builders Mart Pty Ltd and the BCCIEU be approved and registered with the Fair Work Commission. The agreement was to be in effect from 1 July 2013 until 30 June 2016, subject to any amendments or variations that may be agreed upon by the parties. The court also ordered that the costs of the application be paid by the BCCIEU.
