CaseChat Overview and Summary

Core Talent Pty Ltd applied to the Fair Work Commission for approval of a new enterprise agreement, the Core Talent Pty Ltd & ETU NSW Construction Enterprise Agreement 2021. The ETU NSW was the relevant trade union for the employees involved. The nature of the dispute centred on whether the proposed agreement met the legal criteria for approval under the Fair Work Act 2009. The application was heard by the Fair Work Commission, which is tasked with overseeing and approving enterprise agreements in Australia.

The legal issues before the Commission included whether the agreement provided for fair and reasonable terms and conditions, including pay and hours of work. Additionally, the Commission had to determine if the agreement met the requirement of being in writing, whether it was genuinely negotiated between the employer and the union, and whether it complied with any relevant minimum standards set out in the Fair Work Act. The Commission also considered whether the agreement contained proper provisions for employee engagement and consultation.

In reaching its decision, the Commission examined the submissions from both Core Talent Pty Ltd and the ETU NSW, as well as the content of the proposed agreement itself. The Commission found that the agreement was fair and reasonable, as it provided for appropriate pay rates and working conditions that were in line with industry standards. The Commission was satisfied that the agreement was in writing, had been genuinely negotiated, and complied with all relevant minimum standards. The Commission also noted that the agreement contained appropriate provisions for employee engagement and consultation. Consequently, the Commission approved the proposed agreement.

The Fair Work Commission approved the Core Talent Pty Ltd & ETU NSW Construction Enterprise Agreement 2021, confirming that it met all the necessary legal criteria for approval under the Fair Work Act. This decision ensures that the terms and conditions of employment for the employees covered by the agreement are regulated by the approved agreement, providing a framework for fair and reasonable workplace practices.
