CaseChat Overview and Summary

The application before the Fair Work Commission was for the approval of the Control & Electric Pty Ltd Single Enterprise Agreement 2025. The applicant, Control & Electric Pty Ltd, sought approval of the agreement which had been negotiated with the Electrical Trades Union of Australia. The dispute involved the terms and conditions of employment for employees within the organisation, and the specific provisions of the proposed agreement that were subject to contention.

The legal issues before the Commission were centred on whether the agreement met the statutory requirements for approval under the Fair Work Act 2009. These included whether the agreement had been made in good faith, whether it provided for minimum terms and conditions, and whether it met the procedural requirements for certification. Additionally, the Commission needed to consider whether the provisions of the agreement were consistent with the relevant national employment standards.

The Commission found that the agreement had been made in good faith and that it provided for minimum terms and conditions. The Commission also determined that the procedural requirements for certification had been met, including the provision of relevant documents and the opportunity for employees to be represented by a union official. After reviewing the provisions of the agreement, the Commission found that they were consistent with the relevant national employment standards and did not include any terms that were contrary to public policy. As a result, the Commission approved the Control & Electric Pty Ltd Single Enterprise Agreement 2025.
