Construction, Forestry, Mining and Energy Union v Sparta Mining Services Pty Ltd (No 2)

The Construction, Forestry, Mining and Energy Union (CFMEU) appealed against two decisions of the Fair Work Commission, dated 5 July 2016 and 6 July 2016, which dismissed the CFMEU’s claims for unfair dismissal and unlawful termination of employment against Sparta Mining Services Pty Ltd. The decisions were made by Commissioner Spencer at Brisbane in matter number AG2016/2507. The primary dispute centred on the interpretation and application of the Fair Work Act 2009 (Cth) with respect to the termination of employees engaged by Sparta Mining Services.

The legal issues before the court were whether the dismissal of the employees was procedurally unfair and whether the termination of their employment was unlawful. The CFMEU argued that the employees were dismissed without a valid reason and that their dismissals were not carried out in accordance with the procedures set out in the Fair Work Act. The court concluded that the dismissals were procedurally fair as the employees were provided with a valid reason for termination, which was the cessation of their work. The court also found that the dismissals were lawful as the employees were given the opportunity to be accompanied by a support person, albeit in a manner that did not strictly adhere to the prescribed form. Consequently, the court upheld the decisions of the Fair Work Commission, dismissing the CFMEU’s appeal.

The final orders of the court were that the appeal against the decisions of the Fair Work Commission be and hereby is dismissed, and that the CFMEU pay Sparta Mining Services’ costs of the appeal.
