CaseChat Overview and Summary

The Construction, Forestry, Mining and Energy Union (CFMEU) applied to the Fair Work Commission for approval of the CKD Joinery Installations Pty Ltd and the CFMEU (Victorian Construction and General Division) Enterprise Agreement 2016 - 2018. CKD Joinery Installations Pty Ltd opposed the application. The dispute was heard in the Fair Work Commission, with the Hon. Deputy President McCabe presiding. The central legal issue before the court was whether the enterprise agreement met the requirements of section 230 of the Fair Work Act 2009. Specifically, the court had to determine if the agreement provided for the safety, health and welfare of employees, and if it met the "better off overall test" under section 231 of the Act.

The court considered the provisions of the agreement and the evidence presented by both parties. The court found that the agreement provided for the safety, health and welfare of employees, as it included provisions for personal protective equipment, training and supervision. The court also found that the agreement met the "better off overall test" as the employees would receive increased wages and improved conditions. The court was satisfied that the agreement was in the best interests of the employees and approved the application for the agreement to be registered. The Hon. Deputy President McCabe ordered that the CKD Joinery Installations Pty Ltd and the CFMEU (Victorian Construction and General Division) Enterprise Agreement 2016 - 2018 be approved and registered with the Fair Work Commission.
