CaseChat Overview and Summary
The FWC found that the enterprise agreement met the statutory requirements and was made in good faith. The Commission considered the terms and conditions of the agreement, the process by which it was negotiated, and the evidence provided by both parties. The FWC accepted that the agreement included all the minimum terms and conditions required by the Fair Work Act and that it was not made under any duress or coercion. Furthermore, the FWC was satisfied that the negotiation process was fair and that both parties had acted in good faith throughout.
Consequently, the FWC approved the enterprise agreement. The decision was made based on the evidence and submissions presented by both parties and the FWC’s assessment of the agreement against the statutory criteria. The approval of the enterprise agreement allows it to be registered and enforceable under the Fair Work Act, providing the agreed terms and conditions for employees of CIP Constructions (Vic) Pty Ltd and the CFMEU (Victorian Construction and General Division) for the period 2016-2018.
