CaseChat Overview and Summary
The legal issues before the FWC involved whether the agreement provided for fair and reasonable terms and conditions for employees, whether it was free from any unfair provisions, and whether it met the requirements for good faith bargaining. The FWC also had to consider if the agreement provided for an appropriate balance of rights and obligations between the employer and employees, and whether it adhered to the principles of the National Employment Standards.
The FWC determined that the Enterprise Agreement was fair and reasonable, and met the necessary standards under the Act. The FWC found that the agreement provided for fair and reasonable terms and conditions for employees, was free from any unfair provisions, and met the requirements for good faith bargaining. The FWC also considered that the agreement provided for an appropriate balance of rights and obligations between the employer and employees, and adhered to the principles of the National Employment Standards. Accordingly, the FWC approved the Enterprise Agreement between Evolucion Group Pty Ltd and the Construction, Forestry, Mining and Energy Union (Victorian Construction and General Division) for the period 2016-2018.
