CaseChat Overview and Summary
The court had to determine whether the agreement met the criteria set out in the Fair Work Act 2009, specifically whether it was in the interests of employees and whether it complied with the procedural requirements. The CFMEU argued that the agreement was in the best interests of the employees, while the Obic Family Trust contended that certain provisions were unfair and did not comply with the legal requirements.
After careful consideration of the evidence and submissions from both parties, the Commission found that the agreement was in the best interests of the employees and met the procedural requirements for approval. The Commission noted that the agreement provided for fair and reasonable terms and conditions of employment, and that the parties had negotiated in good faith. The Commission also found that the agreement complied with the requirements of the Fair Work Act 2009.
The final orders of the Commission were that the agreement be approved, subject to certain minor modifications to ensure compliance with the Act. The CFMEU and the Obic Family Trust were directed to take all necessary steps to implement the approved agreement.
