CaseChat Overview and Summary

The Construction, Forestry, Mining and Energy Union (CFMEU) filed an application for the approval of the Asset & Facility Management Pty Ltd - CFMEU ESSO Onshore & Offshore Construction Sites Agreement 2013-2015. The matter was heard in the Fair Work Commission. The primary dispute centred on whether the proposed agreement adequately met the requirements for approval under the Fair Work Act 2009, particularly with respect to its compliance with the "better off overall test" and its fairness in terms of workers' rights and obligations.

The legal issues that the Fair Work Commission had to address included whether the agreement provided for appropriate wage rates and conditions that were better off for the majority of employees than what they would have under the applicable awards, and whether the agreement included provisions that were fair in terms of the balance of rights and obligations for both employers and employees. Additionally, the Commission had to consider whether the agreement met the procedural requirements for approval, such as proper bargaining and adequate consultation processes.

In its reasoning, the Fair Work Commission evaluated the terms of the agreement against the statutory criteria. It found that the agreement provided for wages and conditions that were better off overall for the majority of employees and contained provisions that were fair in terms of the balance of rights and obligations. The Commission also determined that the procedural requirements for approval had been met, including the demonstration of genuine bargaining and adequate consultation. Consequently, the Commission approved the agreement, recognising its compliance with the statutory standards and its fairness to the involved parties.

The final orders of the Fair Work Commission included the approval of the Asset & Facility Management Pty Ltd - CFMEU ESSO Onshore & Offshore Construction Sites Agreement 2013-2015, effective from the date of the decision. The agreement was deemed to comply with the relevant provisions of the Fair Work Act 2009 and was authorised for implementation.
