CaseChat Overview and Summary
The central issue before the FWC was whether the proposed agreement met the criteria for approval under section 231 of the Fair Work Act. Specifically, the FWC needed to determine if the agreement provided for the proper operation of enterprises, ensured employees were not worse off, and adhered to the better-off-overall test. The FWC also considered if the agreement complied with the provisions concerning employee representation and the avoidance of industrial action.
The FWC evaluated the agreement provisions, considering the economic and operational context of the industries involved. It found that the proposed agreement provided for the proper operation of enterprises, met the better-off-overall test, and ensured employees were not worse off. The FWC also determined that the agreement did not contravene any relevant laws or principles of natural justice. Therefore, the FWC approved the Garic Engineering Pty Ltd and the CFMEU Rigger / Steel Erector Enterprise Agreement 2011-2015.
