An application has been made for approval of a greenfields agreement known as the Blue Wren Holdings Pty Ltd T/As Civic Shower Screens & Wardrobes (Queens Wharf Project) Union Collective Agreement 2018 (the Agreement). CaseChat Overview and Summary
The primary legal issue the commission had to address was whether the proposed collective agreement complied with the requirements set forth in the Fair Work Act. Specifically, the commission needed to determine if the agreement adhered to the provisions concerning the content and process for approval of union collective agreements. This included examining whether the agreement was made in good faith, and if it contained the necessary provisions regarding employee representation, dispute resolution, and other mandatory terms.
The commission found that the collective agreement proposed by the union met the statutory requirements for approval. The agreement was comprehensive and included all the mandatory terms as required by the Fair Work Act. The commission also determined that the agreement was made in good faith and that the process by which it was negotiated was fair and transparent. Consequently, the commission approved the application and authorised the collective agreement to be registered.
The final orders of the commission included the formal approval and registration of the Blue Wren Holdings Pty Ltd T/As Civic Shower Screens & Wardrobes (Queens Wharf Project) Union Collective Agreement 2018. This decision ensures that the agreement will be legally enforceable, providing a framework for the terms and conditions of employment for the workers involved in the Queens Wharf Project.
