CaseChat Overview and Summary

In the Fair Work Commission, the Construction, Forestry, Maritime, Mining and Energy Union, on behalf of its members, made an application for the approval of the WESTCOAST WINDOWS PTY. LTD. and the CFMEU (Victorian Construction and General Division) Subcontractors Aluminium & Glass Enterprise Agreement 2020-2023. The dispute arose from negotiations between the union and the employer regarding the terms and conditions of employment for workers in the subcontractor aluminium and glass industry. The union sought to have the proposed enterprise agreement, which had been negotiated in good faith, approved by the Commission to ensure that the workers' rights and entitlements were protected.

The legal issues before the Commission included whether the proposed agreement was made in good faith, whether it contained all the mandated terms and conditions, and whether it complied with the relevant provisions of the Fair Work Act 2009. The Commission needed to consider the application of the "better off overall test" to ensure that the proposed agreement provided employees with no less favourable terms and conditions than those provided under the applicable award or safety net award. Furthermore, the Commission had to examine the provisions of the agreement concerning wages, hours of work, leave entitlements, and other employment-related matters.

The Commission found that the proposed enterprise agreement was made in good faith and contained all the mandated terms and conditions. The agreement provided for a wage increase over the period, additional leave entitlements, and other benefits that improved upon the safety net award. The Commission was satisfied that the agreement complied with the "better off overall test" and met the requirements of the Fair Work Act 2009. Consequently, the Commission approved the WESTCOAST WINDOWS PTY. LTD. and the CFMEU (Victorian Construction and General Division) Subcontractors Aluminium & Glass Enterprise Agreement 2020-2023. The agreement will now be in force, providing the workers with improved terms and conditions of employment for the specified period.
