CaseChat Overview and Summary

The matter before the Fair Work Commission involved an application for approval of the Estate Plastering Unit Trust (the Trustee for) and the Construction, Forestry, Maritime, Mining and Energy Union (Victorian Construction and General Division) Plastering Enterprise Agreement 2016-2018. The primary dispute centred on whether the agreement met the criteria for approval under the Fair Work Act 2009. The application was brought before the Commission in its capacity to approve enterprise agreements that offer improved terms and conditions for employees compared to the applicable award.

The central legal issue was whether the agreement provided a safety net of minimum terms and conditions of employment that were no less favourable than those in the relevant award. This involved assessing the terms of the proposed agreement against the National Plasterers Award 2010 to ensure that employees would not be worse off. Additionally, the Commission had to determine whether the agreement facilitated improvements in productivity, efficiency, and profitability in a manner that was not detrimental to employees.

The Fair Work Commission, after thorough examination of the terms and conditions in the proposed agreement, found that it did indeed offer improved terms and conditions compared to the National Plasterers Award 2010. The Commission was satisfied that the agreement provided a safety net of minimum terms and conditions that were no less favourable than those in the applicable award. Furthermore, the Commission determined that the agreement facilitated improvements in productivity, efficiency, and profitability in a manner that was not detrimental to employees. Consequently, the Commission approved the agreement, finding it to be in compliance with the requirements of the Fair Work Act 2009.

As a result of the decision, the Estate Plastering Unit Trust (the Trustee for) and the Construction, Forestry, Maritime, Mining and Energy Union (Victorian Construction and General Division) Plastering Enterprise Agreement 2016-2018 was approved and came into effect. The agreement provided for improved terms and conditions for employees, enhancing their job security and overall working conditions, while also facilitating better business outcomes for the employer.
