CaseChat Overview and Summary

In this matter, the Construction, Forestry, Maritime, Mining and Energy Union (CFMEU) sought approval of a new enterprise agreement with SYNTECH Coatings Pty Ltd for the waterproofing sector. The case was heard in the Fair Work Commission. The CFMEU aimed to have the proposed agreement, which contained specific terms and conditions for subcontractors, ratified under the Fair Work Act 2009.

The court was tasked with determining whether the proposed agreement complied with the relevant provisions of the Fair Work Act. Key issues included whether the agreement met the requirements for "good faith bargaining," if it contained the necessary minimum entitlements, and whether it adhered to the provisions for multi-employer agreements. The court had to assess if the agreement appropriately balanced the interests of the employees and the employer, and if it met the standards set by the Fair Work Act.

The Fair Work Commission found that the agreement was made in good faith and contained the required minimum entitlements. The court considered that the agreement was fair and balanced, as it provided reasonable terms for both parties, and that it was consistent with the provisions for multi-employer agreements. The court concluded that the agreement was compliant with the Fair Work Act and granted approval for the SYNTECH Coatings Pty Ltd and the CFMEU (Victorian Construction and General Division) Subcontractors Waterproofing Enterprise Agreement 2020-2023.

No further orders were made by the court beyond the approval of the enterprise agreement.
