CaseChat Overview and Summary
The central legal issue before the court was whether the Aspire Facades Group NSW Pty Ltd / CFMEU Greenfield Agreement 2019 met the criteria for approval under the Fair Work Act 2009. Specifically, the court had to consider whether the agreement was a "good faith" agreement and whether it was in the best interests of the workers it was intended to cover. The court also needed to determine whether the agreement's scope was appropriate and whether it would lead to industrial action that would be unfair to other employers. The court considered submissions from both parties, as well as evidence from industry experts.
In reaching its decision, the court considered the nature of the work covered by the agreement and the potential for it to extend beyond facades. The court found that the agreement was in good faith and that it was in the best interests of the workers it was intended to cover. The court also found that the scope of the agreement was appropriate and that it would not lead to industrial action that would be unfair to other employers. The court took into account the evidence of industry experts, who confirmed that the work covered by the agreement was limited to the installation and erection of building facades. The court was satisfied that the agreement met the criteria for approval under the Fair Work Act 2009.
The Fair Work Commission approved the Aspire Facades Group NSW Pty Ltd / CFMEU Greenfield Agreement 2019. The court found that the agreement was in good faith, in the best interests of the workers it was intended to cover, and had an appropriate scope. The court also found that the agreement would not lead to industrial action that would be unfair to other employers. The approval of the agreement provides certainty for both the applicant and the workers it covers and ensures that they are able to negotiate their terms and conditions of employment in a fair and effective manner.
