CaseChat Overview and Summary
The primary legal issues before the Commission were whether the agreement met the requirements for approval under the Fair Work Act, including whether it provided for the minimum entitlements of employees, whether it was free from prohibited content, and whether it had been appropriately bargained. The Commission needed to determine if the agreement was in the best interests of the employees and whether it complied with the statutory requirements for enterprise agreements.
In its decision, the Commission examined the terms of the agreement and the process by which it was negotiated. It found that the agreement provided for the minimum entitlements of employees and was free from prohibited content. The Commission also noted that the agreement had been appropriately bargained by the parties. Given these findings, the Commission approved the agreement, recognising that it was in the best interests of the employees and complied with the statutory requirements for enterprise agreements.
The Fair Work Commission approved the XMPLAR FORMWORK PTY LIMITED and CFMEU ACT Enterprise Agreement 2019, confirming its compliance with the Fair Work Act and its appropriateness for the employees involved.
