CaseChat Overview and Summary

The case involved the Construction, Forestry, Maritime, Mining and Energy Union (CFMEU) and Unreal Steel Workforce Pty Ltd. The matter came before the Fair Work Commission and concerned the approval of a collective agreement between the parties, titled the Unreal Steel Workforce Pty Ltd / CFMEU Collective Agreement 2019-2022. The CFMEU sought approval of the agreement, which outlined various terms and conditions of employment for the workers under the agreement. Unreal Steel Workforce Pty Ltd did not oppose the application.

The primary legal issue before the Commission was whether the collective agreement complied with the requirements of the Fair Work Act 2009, specifically in relation to the provision of information and the opportunity for employees to be represented by their chosen representative. The CFMEU argued that the agreement was valid and should be approved, while Unreal Steel Workforce Pty Ltd did not contest the application.

The Commission found that the agreement met the necessary legal requirements. The Commission considered the information provided by the CFMEU and found that it was sufficient and appropriately detailed the terms and conditions of employment. Furthermore, the Commission was satisfied that the agreement provided for the opportunity for employees to be represented by their chosen representative, as required by the Act. In light of these findings, the Commission approved the collective agreement.

The Fair Work Commission approved the Unreal Steel Workforce Pty Ltd / CFMEU Collective Agreement 2019-2022. The Commission found that the agreement complied with the requirements of the Fair Work Act 2009 and was therefore valid and should be approved.
