CaseChat Overview and Summary
The primary legal issue before the Commission was whether the proposed enterprise agreement met the requirements for approval under the Fair Work Act. This involved assessing whether the agreement was made in good faith, whether it contained only matters that could be the subject of an enterprise agreement, and whether it provided for the resolution of disputes and the protection of employees. The Commission also had to consider the views of the employer and the union regarding the application of the agreement to the employer's employees.
In considering the matter, the Commission noted that the agreement was made in good faith and contained only matters that could be the subject of an enterprise agreement. The Commission also found that the agreement provided for the resolution of disputes and the protection of employees. The Commission accepted the union's submission that the agreement was suitable for registration and approval, despite the employer's concerns regarding the application of the agreement to its employees. The Commission concluded that the agreement met the criteria for approval under the Fair Work Act.
