CaseChat Overview and Summary
The central legal issue before the Commission was whether the proposed enterprise agreement complied with the relevant legislative requirements. Specifically, the Commission had to determine if the agreement met the criteria set out in the Fair Work Act 2009, including whether it was made in good faith and if it provided for fair and reasonable terms and conditions of employment. The Commission also needed to consider if the agreement was consistent with the national system of industrial determination.
The Fair Work Commission found that the proposed enterprise agreement was made in good faith and provided for fair and reasonable terms and conditions of employment. The Commission concluded that the agreement was consistent with the national system of industrial determination and was therefore eligible for approval and registration. The Commission also noted that the agreement contained provisions that were designed to ensure compliance with safety standards and protect the rights of workers. The Commission approved the agreement, and it was registered with the Fair Work Ombudsman.
The Fair Work Commission approved and registered the Subcontractors Rigger/Steel Erector Enterprise Agreement 2020-2023, finding it to be in compliance with the Fair Work Act 2009. The agreement will now govern the employment terms and conditions for subcontractors in the rigging and steel erecting industry for the period 2020-2023.
