CaseChat Overview and Summary
The legal issues before the FWC were whether the proposed enterprise agreement met the necessary requirements under the Fair Work Act 2009 and if it provided for the fair and equitable treatment of employees. This included assessing if the agreement was genuinely negotiated and if it contained the necessary minimum terms and conditions for the employees.
In its decision, the FWC examined the evidence provided by both parties and the provisions of the proposed agreement. The FWC found that the agreement had been genuinely negotiated and contained all the required minimum terms and conditions. Furthermore, the FWC determined that the proposed agreement was fair and reasonable, providing for the equitable treatment of employees. Consequently, the FWC approved the Subcontractors Cleaning Enterprise Agreement 2020-2023.
The FWC's approval of the agreement meant that it would now be a legally binding enterprise agreement between Action Cleaning Group Vic Pty Ltd and the CFMEU (Victorian Construction and General Division) Subcontractors. This decision ensured that the employees covered by the agreement would receive the protections and entitlements outlined in the approved agreement.
