CaseChat Overview and Summary
The central legal issue was whether the proposed agreement complied with the formal and substantive requirements set forth in the Fair Work Act 2009. The formal requirements included ensuring that the agreement was in writing, contained certain prescribed particulars, and was made by an authorised bargaining representative. The substantive requirements included assessing whether the agreement promoted high wages and high levels of employment and job security, and did not undermine the ability of employees to protect their health, safety and welfare. Additionally, the Commission needed to ensure that the agreement did not include any provisions that were contrary to public policy.
The Fair Work Commission, after reviewing the submissions and evidence provided by both parties, determined that the proposed agreement met the formal requirements for approval. The Commission noted that the agreement contained all the prescribed particulars and was made by an authorised bargaining representative. Furthermore, the Commission found that the agreement promoted high wages and high levels of employment and job security, and did not undermine the ability of employees to protect their health, safety and welfare. The Commission also found that the agreement did not include any provisions that were contrary to public policy. As such, the Commission approved the proposed agreement.
The Fair Work Commission approved the Construction, Forestry, Maritime, Mining and Energy Union (CFMEU) (Victorian Construction and General Division) Subcontractors Aluminium & Glass Enterprise Agreement 2020-2023, finding it to be in compliance with the formal and substantive requirements set forth in the Fair Work Act 2009. This decision ensures that the employees of M&I FACADE PTY LTD are covered by an agreement that meets the necessary legislative standards.
