CaseChat Overview and Summary
The key legal issues before the Commission were whether the agreement was a "good faith" bargain, whether it contained permissible terms under the Act, and if the agreement complied with the "better off overall test" (BOOT). This test requires that the proposed agreement must not disadvantage the employees any more than they would be without the agreement, and preferably, it must provide some advantage.
The Commission found that the agreement was a genuine attempt at good faith bargaining, and the terms proposed were within the permissible limits under the Act. The Commission also concluded that the agreement met the BOOT, as it provided for fair and reasonable terms for the employees. The proposed wages and conditions were considered to be at least as good as, and in some cases better than, the existing conditions. The Commission approved the agreement, noting that it provided for a fair and reasonable outcome for both parties.
The Fair Work Commission approved the QLD Concrete Drilling & Sawing Pty Ltd and CFMEU Union Collective Agreement 2020-2022, finding it to be a genuine good faith bargain and compliant with the statutory requirements under the Fair Work Act 2009. The Commission determined that the agreement met the better off overall test, providing fair and reasonable terms for the employees.
