CaseChat Overview and Summary
The key legal issues that the Commission had to address included whether the agreement complied with the statutory requirements set out in the Fair Work Act 2009, particularly in relation to the coverage of employees, the process by which the agreement was formed, and whether it met the "better off overall test". This test requires that employees be no worse off financially and have improved conditions in at least one area compared to the previous agreement or applicable award.
The Commission examined the evidence presented by both parties and considered the provisions of the Fair Work Act, relevant case law, and the principles of good faith bargaining. The Commission found that the agreement had been formed through genuine and meaningful consultation and negotiation between the parties. It was also determined that the agreement met the "better off overall test", as it provided for a modest increase in wages and improved conditions for employees. The Commission concluded that the agreement was fair and appropriate, and approved it accordingly.
In approving the enterprise agreement, the Commission ordered that it be registered with the Fair Work Commission, and that it would be in effect from the date of registration for a period of four years, until 30 June 2024. The agreement would then be subject to further negotiation between the parties or termination in accordance with the Fair Work Act.
