CaseChat Overview and Summary
The Fair Work Commission found that the proposed enterprise agreement met the necessary criteria for approval. It was determined that the agreement contained fair and reasonable terms and conditions for employees and did not include any terms that were contrary to public policy or invalid. The Commission noted that the agreement provided for appropriate safeguards for employee rights and did not undermine the national system of pro-productivity industrial relations. Furthermore, the Commission was satisfied that the agreement was consistent with relevant industry standards and reflected the needs of the mobile crane hiring industry. The Commission approved the agreement, recognising it as a modern award under the Fair Work Act 2009. The approval was granted on the condition that the agreement would be in effect from the date of the Commission's decision and would remain in force until the end of the specified period, subject to any further variations or terminations in accordance with the Act.
