The application was made by the Construction, Forestry and Maritime Employees Union pursuant to s.185 of the Fair Work Act 2009 (Act).
The Fair Work Legislation Amendment (Secure Jobs, Better Pay) Act 2022 (Cth) (Amending Act) made a number of changes to enterprise agreement approval processes in Part 2-4 of the Fair Work Act, that commenced operation on 6 June 2023. CaseChat Overview and Summary
The primary legal issue before the FWC was whether the proposed collective agreement complied with the provisions of the Fair Work Act 2009. Specifically, the Commission had to consider if the agreement met the requirements for "registered agreements" as outlined in the Act. This involved examining whether the agreement had been made genuinely and in good faith, whether it complied with the procedural requirements, and whether it was fair and reasonable in the context of the bargaining process. The FWC also needed to determine if the agreement addressed key employment matters and provided for the resolution of any future disputes.
In reaching its decision, the FWC considered the submissions from both parties and the evidence presented. The Commission found that the agreement had been made genuinely and in good faith, and that it met all procedural requirements. The FWC also concluded that the terms of the agreement were fair and reasonable, taking into account the nature of the industry, the bargaining positions of the parties, and the broader economic context. The agreement addressed key employment matters, including wages, hours of work, and other conditions of employment, and provided for the resolution of any future disputes through the Commission. Based on these findings, the FWC approved the collective agreement as compliant with the Fair Work Act.
The final orders of the FWC were to approve the collective agreement between Ulster Services PTY LTD and the CFMEU for the period 2023 to 2027, subject to the terms and conditions set out in the agreement. The approval was effective from the date of the Commission's decision, and both parties were required to comply with the terms of the agreement. The FWC also noted that any disputes arising from the agreement could be referred back to the Commission for resolution.
