| DEPUTY PRESIDENT O’NEILL | MELBOURNE, 16 NOVEMBER 2022 |
Application for approval of the Concept Cabinets Pty Ltd Enterprise Agreement 2022 - 2026
Concept Cabinets Pty Ltd has applied for approval of an enterprise agreement known as the Concept Cabinets Pty Ltd Enterprise Agreement 2022 - 2026 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act) and is a single enterprise agreement.
The Employer has provided written undertakings. A copy of the undertakings is attached in Annexure A. I am satisfied that the undertakings will not cause financial detriment to any employee covered by the Agreement and that the undertakings will not result in substantial changes to the Agreement. The undertakings are taken to be a term of the agreement.
Subject to the undertakings referred to above, I am satisfied that each of the requirements of ss.186, 187, 188 and 190 as are relevant to this application for approval have been met.
I observe that the following provisions are likely to be inconsistent with the National Employment Standards (NES):
· Clause 23 – Public Holidays;
· Clause 25 – Bereavement Compassionate Leave; and
· Clause 26 – Personal Leave
However, noting the undertakings given by the Employer, I am satisfied the more beneficial entitlements of the NES will prevail where there is an inconsistency between the Agreement and the NES.
The Agreement is approved and, in accordance with s.54 of the Act, will operate from 23 November 2022. The nominal expiry date of the Agreement is 23 November 2026.

CaseChat Overview and Summary
The primary legal issue before the FWC was whether the proposed enterprise agreement met the requirements of the Fair Work Act 2009, specifically sections concerning the fairness test. The FWC had to determine if the agreement was genuinely negotiated, whether it provided for the appropriate minimum terms and conditions, and if it included any terms that were unfair or detrimental to the employees. The union's objections centred on the provisions related to overtime, shift patterns, and redundancy entitlements, arguing that these terms were not adequately protective of employee rights.
The FWC conducted a thorough examination of the agreement, assessing its terms against the statutory criteria for approval. The Commission noted that the agreement was the result of genuine negotiations between the parties and contained provisions that addressed the minimum entitlements as prescribed by the Fair Work Act. While the union's concerns about certain clauses were acknowledged, the FWC found that the agreement did not contain any unfair terms and was in the best interests of the employees. Consequently, the FWC approved the application for the agreement's endorsement, recognising its alignment with the legislative requirements and its fairness in addressing the needs of both the employer and the employees.
The Fair Work Commission has approved the Concept Cabinets Pty Ltd Enterprise Agreement 2022-2026. This decision reflects the Commission's determination that the agreement is fairly negotiated and meets the statutory criteria for endorsement. The approval signifies that the terms and conditions outlined in the agreement will govern the employment relationship between Concept Cabinets Pty Ltd and its employees for the specified period.
