CaseChat Overview and Summary

In the matter of the Fair Work Commission, Compass Group (Australia) Pty Ltd, trading as ESS, applied for approval of the Compass Group - ESS Offshore Oil & Gas (Woodside Platforms) Enterprise Agreement 2019. The dispute was between the employer, Compass Group, and the trade union, United Voice, representing the employees. The application was brought before the Commission in light of the Fair Work Act 2009.

The legal issues before the Commission were whether the agreement was a "single enterprise agreement," if it was "in the best interests of the employees," and if it contained the required minimum terms and conditions of employment. The Commission had to consider the application and the submissions made by both parties to determine if the agreement met the statutory requirements for approval.

The Fair Work Commission considered the provisions of the agreement and the submissions from both parties. The Commission found that the agreement was a single enterprise agreement, as it covered all employees within the defined enterprise. The Commission also found that the agreement was in the best interests of the employees, as it provided for fair and reasonable terms and conditions of employment. The Commission approved the agreement, as it contained all the required minimum terms and conditions of employment, as stipulated in the Fair Work Act 2009.

The Fair Work Commission approved the Compass Group - ESS Offshore Oil & Gas (Woodside Platforms) Enterprise Agreement 2019, effective from 1 July 2019. The decision was made on 23 June 2020 and is binding on all parties involved. The Commission's decision ensures that the employees are protected under the agreement and that the employer complies with the statutory requirements.
