CaseChat Overview and Summary

This matter concerned an application for a Prospective Marriage (Temporary) (Class TO) visa, subclass 300. The applicant sought review of a decision not to grant the visa. The core of the dispute revolved around whether the applicant and the sponsor genuinely intended to marry and live together as spouses.

The legal issues before the Tribunal were whether the parties met the requirements of clauses 300.211 and 300.214 of the Migration Regulations 1994, which relate to the intention to marry an Australian citizen or permanent resident and having met and known each other personally, respectively. Crucially, the Tribunal was required to determine whether the parties had a genuine intention to marry and, as stipulated by clause 300.216, a genuine intention to live together as spouses at the time of the application.

The Tribunal considered the definition of "spouse" under section 5F of the Migration Act 1958, which requires a mutual commitment to a shared life as a married couple to the exclusion of all others, and that the couple lives together or not permanently apart. While not assessing if the parties were spouses at the time of application, the Tribunal examined their intentions in light of this definition. The Tribunal noted a lack of meaningful discussions about future living arrangements and found that the significant age difference and religious difference between the parties, alongside the nature of their commitment and the financial aspects of the relationship, did not support a genuine intention to live together as spouses.

Consequently, the Tribunal found that the applicant did not satisfy the criteria for the grant of the visa and affirmed the decision not to grant the Prospective Marriage (Temporary) (Class TO) visa.
