CaseChat Overview and Summary

The Fair Work Commission heard an application from the Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia (CEPU) to extend the 30-day period for the commencement of protected industrial action. The application was in relation to a protected action ballot held in matter B2023/635 and declared on 5 July 2023. Icon Distribution Investments Limited and Jemena Networks (Act) Pty Ltd T/A Evoenergy (Evoenergy) did not object to the application. The CEPU sought an extension of the 30-day period for the commencement of protected industrial action for eligible CEPU members employed by Evoenergy, pursuant to section 459(3) of the Fair Work Act 2009.

The legal issue before the Fair Work Commission was whether the application by the CEPU should be granted. The CEPU argued that each of the relevant requirements had been met and that the period should be extended by a further 30 days. The Fair Work Commission considered the application and the relevant provisions of the Act. The Commission was satisfied that the relevant requirements of the Act had been met and that the application should be granted.

Accordingly, the Fair Work Commission ordered that the 30-day period for the commencement of protected industrial action for eligible CEPU members employed by Evoenergy be extended by a further 30 days. The order will operate on and from 7 August 2023.
