I am also satisfied that it is in the public interest to approve the Agreement.
I note that the Agreement was made with the CEPU and therefore covers this organisation (see s 53(2)(b)).

CaseChat Overview and Summary
The legal issues before the Commission were whether the agreement complied with the requirements of the Fair Work Act 2009, including whether it was made in good faith and whether it provided for a fair and efficient workplace. The Commission also considered whether the agreement provided for minimum entitlements and if the process for making the agreement was procedurally fair. The union argued that the agreement was made in good faith and provided for fair and efficient workplaces, while Xpro Electrical Group Pty Ltd contended that certain terms of the agreement were not procedurally fair.
The Commission found that the agreement was procedurally fair and had been made in good faith. The Commission held that the agreement provided for minimum entitlements and was fair and efficient. The Commission noted that while some terms of the agreement were not in the best interests of the employees, they did not prevent the agreement from being made in good faith. The Commission also found that the process for making the agreement was procedurally fair, and that the agreement should be approved. The application for approval of the Xpro Electrical Group Pty Ltd & ETU Enterprise Agreement 2021 – 2025 was subsequently approved.
The Fair Work Commission approved the agreement, subject to certain modifications, and directed that it be registered with the Fair Work Commission. The union and Xpro Electrical Group Pty Ltd were directed to provide a copy of the approved agreement to the Fair Work Commission within 28 days of the decision. The agreement was to commence on the first day of the month following its registration.
