CaseChat Overview and Summary

In the Fair Work Commission, the Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia lodged an application for approval of the JJJ & S Cutajar Pty Ltd and ETU Victorian Rail Infrastructure Enterprise Agreement 2021-2025. The agreement was entered into by the union on behalf of its members who are employed by the respondent company in various roles across the rail infrastructure sector in Victoria. The union sought the Commission's approval under section 234 of the Fair Work Act 2009, asserting that the agreement met the criteria for direct action by the Commission.

The primary legal issue before the Commission was whether the enterprise agreement complied with the requirements of the Fair Work Act, including the provisions for direct action. Specifically, the Commission had to consider whether the agreement provided for a fair and efficient workplace, ensured appropriate levels of employee protection, and complied with the relevant provisions of the Act. Additionally, the Commission needed to determine if the agreement met the criteria for direct action, including whether it addressed issues of mutual interest and promoted cooperative industrial relations.

After examining the agreement and the submissions from both parties, the Commission found that the enterprise agreement was fair and met the criteria for direct action. The agreement contained provisions that ensured a fair and efficient workplace, provided appropriate levels of employee protection, and complied with the relevant provisions of the Fair Work Act. The Commission was satisfied that the agreement addressed issues of mutual interest and promoted cooperative industrial relations between the employer and the employees. Consequently, the Commission approved the enterprise agreement under section 234 of the Fair Work Act.

The Fair Work Commission approved the JJJ & S Cutajar Pty Ltd and ETU Victorian Rail Infrastructure Enterprise Agreement 2021-2025, effective from the date of the decision. The agreement now serves as a binding framework for the terms and conditions of employment for the employees covered by the agreement, ensuring a fair and efficient workplace and promoting cooperative industrial relations.
