CaseChat Overview and Summary

The matter before the Fair Work Commission involved an application for the approval of an enterprise agreement between Defence Fire Protection Pty Ltd and the Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia (CEPU) – Plumbing Division (Vic) for the period 2024 to 2027. The union sought approval of the agreement, which had been negotiated and agreed upon by the parties involved, to ensure it met the legal requirements and standards set by the Fair Work Act 2009.

The primary legal issue before the Commission was whether the agreement complied with the provisions of the Fair Work Act, specifically focusing on the procedural fairness and substantive fairness of the agreement. Procedural fairness required the Commission to consider whether the union had genuinely bargained with the employer and whether the agreement had been made in good faith. Substantive fairness involved assessing whether the terms and conditions of the agreement were fair and reasonable, taking into account the needs and interests of both the employees and the employer.

In reaching its decision, the Commission reviewed the evidence presented by the union and the employer regarding the bargaining process, the terms of the agreement, and the impact on the employees. The Commission found that the agreement had been negotiated in good faith and that the union had genuinely bargained with the employer. The terms of the agreement were deemed to be fair and reasonable, providing appropriate protections and benefits for the employees while also considering the employer's operational needs. Consequently, the Commission approved the enterprise agreement, confirming its compliance with the Fair Work Act.

The final orders of the Commission included the approval of the Defence Fire Protection Pty Ltd and CEPU – Plumbing Division (Vic) Fire Protection Enterprise Agreement 2024 – 2027, effective from the date of the decision. The agreement was to be registered with the Fair Work Commission and would govern the employment terms and conditions of the employees covered by the agreement for the specified period.
