CaseChat Overview and Summary
The legal issues that the Commission was required to determine included whether the agreement met the requirements for approval under the Fair Work Act 2009. Specifically, the Commission needed to consider if the agreement had been made in the "best interests" of the employees and whether it contained appropriate dispute resolution procedures. Another key issue was whether the agreement provided for appropriate minimum terms and conditions of employment.
In reaching its decision, the Commission examined the provisions of the proposed agreement and the submissions made by the parties. The Commission noted that the agreement provided for fair wages and conditions, and that it included provisions for dispute resolution that were considered to be appropriate. The Commission also found that the agreement was in the best interests of the employees, as it provided for a fair and equitable outcome for both parties. The Commission approved the agreement, noting that it met the requirements for approval under the Fair Work Act.
The Commission made orders approving the Central Plumbing (NSW) Pty Ltd & CEPU Plumbing Division - NSW Branch Plumbing Enterprise Agreement 2015-2019, subject to certain conditions. These conditions included the requirement that the agreement be registered with the Fair Work Commission, and that any changes to the agreement be approved by the Commission before they can take effect. The Commission also noted that the agreement would expire on the date specified in the agreement, and that any disputes arising out of or in connection with the agreement would be dealt with in accordance with the dispute resolution procedures contained in the agreement.
