CaseChat Overview and Summary

The applicant, the Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia, sought approval of the Dependable Fire Services Pty Ltd & CEPU NSW/NFIA Sprinkler Fitting Fire Protection Union Enterprise Agreement NSW & ACT 2015 - 2019. The dispute was heard by the Fair Work Commission, presided over by Deputy President W M Whybrow. The legal issues before the court centred on whether the proposed enterprise agreement complied with the relevant provisions of the Fair Work Act 2009. Specifically, the court had to determine if the agreement was "better off overall" for the employees it covered and if it contained any provisions that contravened the "good faith" requirement under the Act.

In examining the agreement, the court considered various factors, including the financial implications for employees, the overall fairness of the terms, and whether the agreement was negotiated in good faith. The court found that the proposed agreement met the "better off overall test" and did not contain any provisions that would contravene the good faith requirement. The court was satisfied that the agreement provided a fair and reasonable set of terms for the employees, and that the negotiation process had been conducted in good faith. Consequently, the court approved the enterprise agreement.

The Fair Work Commission approved the Dependable Fire Services Pty Ltd & CEPU NSW/NFIA Sprinkler Fitting Fire Protection Union Enterprise Agreement NSW & ACT 2015 - 2019, effective from 1 July 2015 for a period of four years. This decision concluded that the agreement met all the necessary legal criteria and was in the best interest of the employees involved.
