CaseChat Overview and Summary
The legal issues before the Commission were whether the agreement met the requirements of the Fair Work Act, including whether it provided for a fair and reasonable safety net of minimum wages and conditions, and whether it was free from any coercion or undue influence. The Commission also had to consider whether the agreement complied with any relevant awards or other industrial instruments. The union argued that the agreement was fair and reasonable and met all the necessary criteria, while the employer argued that the agreement was a genuine bargain and met all the legal requirements.
After considering the evidence and arguments presented by both parties, the Commission found that the agreement met all the necessary criteria for approval. The Commission found that the agreement provided for a fair and reasonable safety net of minimum wages and conditions, and that it was free from any coercion or undue influence. The Commission also found that the agreement complied with all relevant awards and industrial instruments. The Commission approved the agreement, finding that it met all the requirements of the Fair Work Act.
The Commission made orders approving the P.M.T. Security Systems Pty. Ltd. and ETU Enterprise Agreement 2017 - 2021, and registered the agreement with the Commission. The agreement is now legally binding on the employer and all employees within its scope, and will remain in effect until the end of the agreement period or until it is varied or replaced by a new agreement. The decision provides guidance for employers and employees in the communications, electrical, electronic, energy, information, postal, plumbing and allied services industries on the requirements for an enterprise agreement to be approved by the Fair Work Commission.
