CaseChat Overview and Summary
The primary legal issues before the Commission involved the assessment of the agreement against the statutory requirements of the Fair Work Act. These included whether the agreement was made in good faith and covered all relevant terms of employment, and if it met the Fair Work Act's "better off overall test". The Applicant argued that the agreement was fair and reasonable, while the Employer raised concerns about certain terms impacting the business's operational flexibility and cost structure.
The Fair Work Commission examined the evidence provided by both parties and considered the terms of the agreement in light of the statutory requirements. The Commission found that the agreement met the good faith requirement, as it had been negotiated in a cooperative manner, and all relevant terms of employment were covered. The Commission also determined that the agreement passed the "better off overall test", as the majority of employees would receive a benefit in terms of wages, conditions, or both, outweighing any minor disadvantages. Consequently, the Commission approved the agreement.
The Fair Work Commission approved the ETU Enterprise Agreement 2018-2021, finding it to be fair and reasonable, and in compliance with the statutory requirements of the Fair Work Act.
