CaseChat Overview and Summary

The union, Communications, Electrical, Electronic, Energy, Information, Postal, Plumbing and Allied Services Union of Australia, sought approval of a collective agreement from the Fair Work Commission. The agreement was for the CEPU Plumbing Division TVHD Fire Services Union Collective Agreement 2021-2023. BSA Advanced Property Solutions (FIRE) Pty Ltd contested the application. The union argued that the agreement was necessary to resolve disputes and regulate the employment relationship, while the employer argued that the agreement contained provisions that were inconsistent with the Fair Work Act 2009 (Cth). The Fair Work Commission was required to decide whether the agreement met the requirements of the Act and whether it was in the best interests of the employees.

The union contended that the agreement was necessary to provide fair and reasonable terms and conditions of employment for the employees. The employer argued that the agreement contained provisions that were inconsistent with the Act, including provisions that allowed for the unilateral termination of employment. The Commission found that the agreement contained provisions that were inconsistent with the Act, including provisions that allowed for the unilateral termination of employment. However, the Commission also found that the agreement was in the best interests of the employees and approved the agreement.

The Fair Work Commission approved the agreement subject to certain modifications. The modifications included removing provisions that allowed for the unilateral termination of employment and inserting provisions that provided for the fair and reasonable resolution of disputes. The Commission found that the modified agreement met the requirements of the Act and was in the best interests of the employees. The Commission also found that the modified agreement provided for the fair and reasonable regulation of the employment relationship.
