Collu (Migration)

The Administrative Appeals Tribunal considered the applications of Mr. Collu and his spouse for a Subclass 485 (Temporary Graduate) visa, Graduate Work stream. The dispute concerned whether Mr. Collu's nominated occupation as an Electrician (General) was correctly assessed, with the delegate having identified it as an Electronics Trades Worker.

The Tribunal was required to determine whether the applicants met the criteria for the grant of the visa, specifically in relation to the nominated occupation and the relevant legislative provisions. The core legal issue was the correct classification of the applicant's trade qualification and work experience within the framework of the Skilled (Provisional) (Class VC) visa subclass.

The Tribunal found that the primary applicant had satisfied the criteria for the grant of a 485 Visa. Consequently, it followed that the secondary applicant, as a member of the family unit, also met the required criteria. The Tribunal remitted the applications for reconsideration, directing that the applicants meet the criteria specified in cl 485.222 and cl 485.311 of Schedule 2 to the Regulations.
