Coles Supermarkets Australia Pty Ltd v Taylor [2004] NSWCA 347 [2004] NSWCA 347 29 September 2004

CaseChat Overview and Summary

Coles Supermarkets Australia Pty Ltd appealed to the New South Wales Court of Appeal against a judgment of the District Court in favour of the respondent, Mr Taylor. Mr Taylor had sued Coles for damages for negligence, alleging that his overuse injury was caused by his employment.

The Court of Appeal was required to determine whether Coles had breached its duty of care to Mr Taylor by failing to implement a safe system of work, specifically in relation to the recognised risks of overuse injury associated with his role. The court also considered whether Mr Taylor had been adequately advised of these risks and instructed on safer methods of work.

The Court of Appeal found that Coles was in breach of its duty of care. It reasoned that the employer had a responsibility to take reasonable steps to prevent foreseeable injury to its employees. This included advising employees of known risks associated with their work and instructing them on how to minimise those risks. The court concluded that Coles had failed to do so, and that this failure contributed to Mr Taylor's injury.

The appeal was allowed in part. The District Court's judgment was set aside, except for the costs order, and substituted with a judgment for Mr Taylor in a reduced amount. Mr Taylor was ordered to pay one-third of Coles' costs of the appeal, but was granted a certificate under the Suitors' Fund Act 1951.
