CaseChat Overview and Summary
In the matter of *Colby & Coppola and Ors (No. 2)*, heard before Baumann J of the Family Court of Australia, the applicant wife sought financial relief against her husband (the First Respondent), his brother (the Second Respondent), and a company, L Pty Ltd (the Third Respondent). The Second and Third Respondents applied for summary dismissal of the wife's claims against them.
The central legal issue before the court was whether the wife's claims against the Second Respondent and the Third Respondent had any reasonable prospect of success. The wife alleged that L Pty Ltd was deliberately formed to defeat her claim for financial relief, that the business and its equipment were a continuation of the family business, and that the Second Respondent had not paid for the equipment from his personal resources. She further contended that the Third Respondent was effectively splitting one person's wage between the First Respondent and his de facto partner, transferring lump sums to them, and paying for some of their personal items, with the First Respondent controlling the business and the other respondents.
Baumann J considered the wife's affidavit, which detailed her allegations of deceitful actions, the deliberate formation of L Pty Ltd to defeat her claim, and the use of the business and its assets as if they were the First Respondent's own. The court noted the wife's assertion that significant cash was missing, debts were substantial, and false statements had been made, raising the probability of hidden assets. The judge concluded that while there were complex issues to be resolved between the husband and wife regarding divisible assets, the wife's claim against the Second and Third Respondents lacked any reasonable prospects of success.
Consequently, the court ordered the summary dismissal of the application against the Second and Third Respondents and their removal as parties to the proceedings. The substantive proceedings were to be listed for a Case Management Hearing, with directions for trial to be made. The court also set out a timetable for any applications for costs by the Second and Third Respondents, to be dealt with by written submissions.
