CaseChat Overview and Summary

The applicants, Coca-Cola Europacific Partners (Aust) Pty Ltd, sought approval of the Coca-Cola Europacific Partners (Aust) Pty Ltd, Western Australia Equipment Services Enterprise Agreement 2023-2027. The respondents were the Australian Manufacturing Workers' Union and the United Voice, who represented certain employees of the applicants. The application was heard by the Fair Work Commission, which was required to determine whether the proposed agreement met the requirements of the Fair Work Act 2009.

The legal issues before the Commission were whether the proposed agreement was in the interests of the employees, provided for procedural fairness in the workplace, and was otherwise consistent with the objects of the Fair Work Act. The respondents raised objections to certain provisions of the agreement, including the proposed reduction of shift penalties and the removal of certain paid meal breaks. The applicants argued that the changes were necessary to improve operational efficiency and competitiveness.

The Commission considered the evidence presented by both parties and found that the proposed agreement met the requirements of the Fair Work Act. The Commission was satisfied that the agreement provided for procedural fairness and was in the interests of the employees, taking into account the economic and operational context of the applicants' business. The Commission noted that the proposed changes to shift penalties and meal breaks were reasonable and proportionate, and did not undermine the rights and protections of the employees. The Commission approved the proposed agreement, subject to certain minor modifications to address the respondents' concerns.

The Fair Work Commission approved the Coca-Cola Europacific Partners (Aust) Pty Ltd, Western Australia Equipment Services Enterprise Agreement 2023-2027, with certain modifications. The agreement will now be binding on the applicants, the respondents, and the employees covered by the agreement for the period of 2023-2027.
