[1] An application has been made for approval of an enterprise agreement known as the CBH Albany Maintenance Union Collective Agreement 2014 (the Agreement). The application was made pursuant to s.185 of the Fair Work Act 2009 (the Act). The Agreement is a single-enterprise agreement.

[2] I am satisfied that each of the requirements of ss.186, 187 and 188 of the Act as are relevant to this application for approval have been met.

[3] The “Automotive, Food, Metals, Engineering, Printing and Kindred Industries Union” known as the Australian Manufacturing Workers’ Union (AMWU), being a bargaining representative for the Agreement, has given notice under s.183 of the Act that it wants the Agreement to cover it. In accordance with s.201(2) of the Act I note that the Agreement covers the organisation.

CaseChat Overview and Summary

The case of Co-operative Bulk Handling Limited concerned an application for the approval of the CBH Albany Maintenance Union Collective Agreement 2014. The applicant, Co-operative Bulk Handling Limited, sought approval of the agreement from the Fair Work Commission, which was necessary for its enforcement and implementation. The application was brought before the Full Bench of the Fair Work Commission.

The legal issues that the court was required to decide included whether the agreement was in the best interests of the employees and whether it complied with the relevant provisions of the Fair Work Act 2009. The court also had to determine whether the agreement met the requirements for approval under the Fair Work Act 2009, such as whether it was a genuine agreement and whether it contained the necessary provisions for the protection of employees' rights and interests.

The court's reasoning and outcome were based on a thorough analysis of the agreement and the relevant legal provisions. The court found that the agreement was in the best interests of the employees and met the requirements for approval under the Fair Work Act 2009. The court also found that the agreement contained the necessary provisions for the protection of employees' rights and interests, including provisions for the resolution of disputes and the protection of employees' health and safety. The court approved the agreement, subject to certain modifications to ensure that it complied with the relevant legal provisions.

The final orders of the court included the approval of the CBH Albany Maintenance Union Collective Agreement 2014, subject to certain modifications, and the direction that the agreement be registered with the Fair Work Commission. The court also directed that the agreement be notified to the parties and that it would come into effect on a specified date. The orders were made to ensure that the agreement was enforceable and that the rights and interests of the employees were protected.
