Close & Close (No 2)

In *Close & Close (No 2)*, Aldridge J of the Family Court of Australia considered an application for costs following proceedings between a husband and wife. The dispute concerned the wife's requests for disclosure of documents from the husband and her attempts to obtain documents requested by a single expert, as well as the costs associated with an application filed on 10 December 2013.

The court was required to determine the extent to which the husband should be ordered to pay the wife's costs. Specifically, the issues revolved around the costs incurred by the wife in seeking disclosure from the husband in accordance with previous orders made since 1 April 2011, and in her efforts to obtain documents identified by a single expert. Aldridge J ordered that the husband pay the wife's costs related to her requests for disclosure from him, as mandated by orders made since 1 April 2011, and her efforts to secure documents sought by any single expert in the proceedings. Furthermore, the husband was ordered to pay the wife's costs of and incidental to the Application in a Case filed on 10 December 2013. These costs were to be paid forthwith upon agreement, taxation, or assessment, with such taxation or assessment permitted to proceed immediately.
