CaseChat Overview and Summary
The central legal issue before the Commission was whether the enterprise agreement appropriately balanced the rights and obligations of the employer and the employees. This involved assessing the agreement's compliance with the "better off overall test," which required the Commission to be satisfied that the agreement would not disadvantage employees compared to their existing conditions. The Commission also needed to consider whether the agreement provided for fair and reasonable terms and conditions of employment, including aspects such as wages, working hours, and leave entitlements.
After reviewing the application and the evidence presented by the parties, the Fair Work Commission determined that the Cleanaway Liquid & Technical Services Cairns Enterprise Agreement 2024 met the necessary criteria for approval. The Commission found that the agreement provided for fair and reasonable terms and conditions of employment and that employees would be better off overall under the new agreement. The Commission approved the agreement, noting that it adequately balanced the interests of both the employer and the employees. The decision confirmed that the agreement would be registered and enforceable from the specified commencement date.
