CaseChat Overview and Summary

Cleanaway Operations Pty Ltd applied to the Fair Work Commission for approval of the Cleanaway Melbourne Vehicle Workshops Enterprise Agreement 2017. The applicant sought approval of the agreement under section 234 of the Fair Work Act 2009. The dispute involved whether the agreement complied with the statutory requirements for a modern award and whether it met the requirements for direct bargaining as stipulated in the Act.

The legal issues before the Commission included whether the agreement contained all the terms and conditions of employment as required by section 234(1)(a) of the Act, whether it provided for the operation of a modern award, and whether it was the product of direct bargaining between the employer and employees as mandated by section 234(1)(c). Additionally, the Commission considered whether the agreement met the requirements for direct bargaining as stipulated by section 235 of the Act.

The Fair Work Commission held that the agreement met all the statutory requirements for approval. The Commission found that the agreement contained all the terms and conditions of employment, provided for the operation of a modern award, and was the product of direct bargaining. The Commission further held that the agreement met the requirements for direct bargaining as stipulated by section 235 of the Act. Accordingly, the Commission approved the agreement under section 234 of the Act.

The Commission approved the Cleanaway Melbourne Vehicle Workshops Enterprise Agreement 2017. The approval was effective from the date of the Commission's decision. The agreement was to operate for a period of five years from the date of approval, with provisions for future bargaining and amendments as necessary.
