CaseChat Overview and Summary

Chubb Fire & Security Pty Ltd applied for the approval of the Chubb Fire Safety Perth Electrical Enterprise Agreement-2018 - 2022. The application was heard by the Fair Work Commission. The nature of the dispute involved the proposed agreement's terms and conditions, and the question of whether it met the requirements for approval under the Fair Work Act 2009.

The central legal issue before the Commission was whether the proposed enterprise agreement was procedurally and substantively valid. This included examining whether the agreement was made in good faith, whether it complied with the relevant provisions of the Fair Work Act, and whether it was fair and reasonable in all the circumstances. The Commission also needed to consider whether the agreement provided adequate protections for employees, including those in relation to wages, hours of work, and other conditions of employment.

The Commission found that the proposed agreement was procedurally valid, as it had been made in good faith and followed the necessary procedures. The Commission also found that the agreement was substantively valid, as it provided for fair and reasonable terms and conditions of employment. The Commission noted that the agreement provided for a number of protections for employees, including minimum wage rates, provisions for overtime and penalty rates, and provisions for leave. The Commission was satisfied that the agreement was fair and reasonable in all the circumstances, and approved the Chubb Fire Safety Perth Electrical Enterprise Agreement-2018 - 2022.

The Fair Work Commission approved the Chubb Fire Safety Perth Electrical Enterprise Agreement-2018 - 2022, finding that it was procedurally and substantively valid. The Commission noted that the agreement provided for fair and reasonable terms and conditions of employment, and provided adequate protections for employees. The approval of the agreement means that it will now be legally binding on both the employer and employees covered by the agreement.
