CaseChat Overview and Summary
The legal issues that the Commission was required to decide included whether the agreement complied with the Fair Work Act 2009, particularly in terms of its provisions on minimum wages and conditions, and whether the agreement was made in good faith and without coercion. Additionally, the Commission had to consider whether the agreement met the "better off overall test", ensuring that employees were not worse off under the new agreement compared to their previous conditions.
The Commission found that the proposed agreement was compliant with the Fair Work Act and had been made in good faith. The Commission also determined that the agreement met the better off overall test, as employees would not be worse off under the new conditions. Consequently, the Commission approved the Christies People Infrastructure Pty. Ltd. Enterprise Agreement 2012-2016. This decision provided clarity on the terms of employment and facilitated a resolution to the dispute between the parties involved.
