Chopra and Child Support Registrar (Child support)

This matter concerned an application by Miss Chopra to the Administrative Appeals Tribunal (the Tribunal) for an extension of time to seek a review of a child support objection decision made by the Child Support Registrar on 23 April 2020. The application for extension was lodged on 15 June 2020, approximately 25 days after the expiry of the usual 28-day period for lodging an application for review. The Tribunal considered the application on the papers.

The primary legal issue before the Tribunal was whether to grant Miss Chopra's request for an extension of time to apply for a review of the child support objection decision. In determining this, the Tribunal was required to consider the principles for exercising discretion to grant an extension of time, as established in case law, which involve balancing various factors including the reasons for the delay, the merits of the substantive application, and any prejudice to the parties or the public.

The Tribunal found that Miss Chopra had not provided a satisfactory explanation for the delay. While she cited difficulties in understanding the decision and managing other personal and work commitments, the Tribunal noted she had received a detailed explanation of the decision and her appeal rights on 23 April 2020, and had not sought clarification or further information in a timely manner. Furthermore, the Tribunal found that Miss Chopra's substantive application for review had little merit, as the Child Support Agency had properly considered the relevant legislation and evidence regarding child care costs and the backdating of the assessment. The Tribunal concluded that it would not be proper to grant the extension of time.

Consequently, the Tribunal refused Miss Chopra's application for an extension of time to seek a review of the objection decision.
